Car v. Bicycle
Heinrich Law client Randy Bain was riding his bicycle from the ferry terminal to his home on the island of Alameda when Marcella Burrows made an ill-advised left turn directly into his path of travel, striking him, and sending him to the ground.
Mr. Bain suffered a left femur/hip fracture that required surgery and kept him out of work for months. Mr. Bain was employed as a physician’s assistant in the pediatric neurosurgery ward at UCSF at the time of the incident.
Luckily for Mr. Bain, police and paramedics from the Alameda Police and Fire Department responded to the scene of the incident. The police officers wore body cameras and videotaped their interview of Ms. Burrows, who admitted the sun was in her eyes, and she never saw Mr. Bain. This was critical to the success of the case because Ms. Burrows tried to rewrite history following the incident and claim Mr. Bain was at fault for the collision.
